對於大維修的保固金事宜, 鬍鬚仔的思路如下。
1。到底我地之前法團簽過/簽咗乜嘢文件??
2。到底大維修係完成工程未? 我地而家眼見的工程缺撼,廿多個住戶因維修修而造成的損失, 到底責任誰屬?
3。大維修跟進的管理公司將於5月31日離開, 文件的交收, 會否有遺漏? 新管理公司能否在短時間內接手處理??
4。我地從合約的細則中, 是否有任何保障及對我們有利的條款??
5。就算要支付, 是否要支付全數?? 還是訟裁, 反索償? 那個對我們較有利?
6。現在法團律師, 是否會替我們跟進處理?? 甚至, 主席及另外四名委員, 是否會同鬍鬚仔合作處理??
7。權仍在主席及四名委員身上, 他們的決定就主宰這筆保固金的命運。對上一次的付款, (即第三期支付的七百多萬), 由全體業主決定; (雖然最後法團都是付了鈔);這次的付款, 是否可以由全體業主決定??
8。時間緊逼, 如何可以在短時間內召集到法團會議, 得到議決, 讓法團律師就輝煌的律師信進行回覆??
9。甚至,如何確保業主能得到全部文件的資料才進行議決?? (否則, 又是選新管理公司, 一張紙就要你揀的鬧劇。)
10。迄至今, 兩年的核數報告都沒有, 到底我們目前真實的財政如何??
千蒼百孔, 問題一來便原形畢露! 但現在不是追究的時候, 現在是我們在思考跟住點樣行落去的時候。
先寫下思路的大鋼, 以便集思廣益, 否則, 東拉西扯對解決問題無用, 反而添煩添亂。謹此拋磚引玉, 亦期望屋苑有識之仕, 能作出指導及修正。
當大家都經過深思熟慮, 便能做出決定。有了決定, 方向便清晰了, 處理便容易了。
On the contract, there would always be a clause to identify the completion of the project, which is to obtain the signoff agreement for the particular phase of the project (if the project firms adopts the ISO standard in undergoing project management).
回覆刪除The signoff on the phase completion is evidence to the requirement to pay for the work involved for the phase of the contract. If there was no signoff given, it is normal not to pay the installment.
Similarly, where there is no signoff provided then there is no legal requirement to pay and hence the letter recieved should not be of concern.
However, if signoff was given, in most cases, the period of warranty does not require further signoff. i.e. once the final phase signoff was provided, at the end of the warranty period, there is a mandatory requirement to pay the contract party.
Where a defect was lodge for remediation with the contractor, and there is evidence the defect was raised within the contract period, and it was not rectified by the contractor, the party under legal obligation would still be required to pay, however there should start a negotiation process as to why the client (Seaview Gdn) does not believe there should be full payment. This should go through a legal counsel (lawyer letter) to counterclaim losses arising from the lack of remediation.
This letter should be provided to the contractor within the days requested by the claimant's legal counsel to express the stance of the client.
If the legal representative of the OC does not assist in this matter then the said legal representative is not acting in the best interest of it's client, and hence there are enough grounds to dismiss the said representative.
Further, if the affected owner does not have it's issues addressed, it can take legal action against the management committee for not acting in the best interest of the building common areas, which specifically, brings damage to their private property.
This should be highly considered.

刪除1, 到底法團之前簽過D乜, 佢地無係會議記錄寫低, 我地就唔知。而大維修期間,又換了管理公司, 到底有幾多文件剩低, 我都唔知。 (係同顧問公司對話當中, 都要由對方口中我地先知法團簽過D乜文件, 我地先知俾人搵了笨。)
2, 所以, 法團之前第三期貨款, 係以乜文件來支付? 當日我係業主大會問,李淑玲都唔答我, 書面問佢都唔覆。到底係簽了完工紙? 定係其他? 除咗佢地五位, 無人知。
3, 趁住新昌還在, 我今朝已經要求我地IC, 去盡聯絡番之前經抂里, 睇下有幾多文件可以搵得返俾我地參考, 亦要求提供house account,等我地可以有一個初部的瞭解我地的財務狀況。
4, 我亦要求召開業委會, 但費時主席又借D意唔出現, 已要求IC聯絡主席及四位委員, 我同另外兩位委員就佢。 由於七天內要回覆, 我希望圼期三/四可以有結論, 吩咐律師去回信。
5, 如果主席及四位唔出席, 先再去考慮後備方案。
